Payment Terms

1. Introduction

These Payment Terms (“Payment Terms”) govern the use of payment services on the GigGap platform, operated by GigGap Ltd. (“GigGap,” “we,” “us,” or “our”), a company registered in England and Wales with a branch in Senegal.

Please read these Payment Terms carefully before making or receiving payments through the Platform. By making or receiving payments, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound by these Payment Terms.

These Payment Terms are supplemental to and form part of GigGap’s Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service. In the event of any conflict between these Payment Terms and the Terms of Service, these Payment Terms shall prevail with respect to payment-related matters.

2. Platform Role in Payments

GigGap facilitates payments between Customers and Skilled Workers. GigGap does not itself provide regulated payment services and relies on authorised third-party payment processors to handle all payment transactions. GigGap does not hold funds on deposit and is not licensed as a payment services provider. Payment processing is performed by third-party payment processors on our behalf.

Funds are received and processed by our third-party payment processors and may be held by them on behalf of GigGap and/or the Skilled Worker in accordance with their regulatory permissions. GigGap does not itself hold customer funds as a bank or custodial institution.

Provisions relating to fees, payments, liability, and dispute resolution shall survive termination of your use of the Platform.

Certain features of the payment services may not be available in all jurisdictions and may be modified to comply with local legal or regulatory requirements.

We may restrict, suspend, or refuse transactions where required to comply with applicable laws, regulations, sanctions programmes, or requests from financial institutions or authorities. Nothing in these Payment Terms creates any fiduciary, trustee, or escrow relationship between GigGap and any user.

GigGap acts as a limited payment collection agent for Skilled Workers solely for the purpose of accepting payments from Customers. A Skilled Worker’s obligation to the Customer for the service is fulfilled upon receipt of funds by GigGap (or its payment processor) on the Skilled Worker’s behalf.

3. Payment Processing

3.1 Accepted Payment Methods

We accept payments through various methods, which may include credit/debit cards, mobile money, bank transfers, or existing GigGap Balance. Available payment methods may vary by country and will be displayed at the time of transaction.

3.2 Payment Security

Payments are processed securely through third-party payment processors. We do not store your payment card details on our servers. All payment data is transmitted using industry-standard encryption.

3.3 Payment Authorisation

By submitting a payment, you authorise GigGap and its payment processor to charge the specified amount to your chosen payment method. You represent that you are authorised to use the payment method provided.

3.4 Payment Confirmation

A booking is confirmed only after we receive successful payment authorisation. If payment fails, the booking will not proceed and you will be notified.

3.5 Processing Delays

GigGap is not responsible for delays in payment processing caused by third-party payment processors, banks, mobile money operators, or network issues. We will make reasonable efforts to resolve any processing issues promptly.

3.6 Payment Processor Availability

We do not guarantee the availability, uptime, or performance of any third-party payment processor, and may change or replace payment providers at any time without liability to you.

3.7 Right to Reverse Transactions

We reserve the right to cancel, reverse, or refuse any transaction where we reasonably suspect fraud, unauthorised activity, or a violation of these Terms or applicable law.

4. Service Fees

4.1 Customer Fees

Customers may be charged a service fee on bookings. The applicable fee will be clearly displayed before you confirm a booking. No hidden fees will be applied after confirmation.

4.2 Skilled Worker Fees

Skilled Workers are subject to a commission fee on each completed transaction. The commission rate is specified in your Skilled Worker agreement with GigGap and will be deducted from the transaction amount before funds are made available for withdrawal.

4.3 Fee Changes

GigGap may change its fee structure at any time. Changes to fees will be communicated to affected users at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated fees.

5. Skilled Worker Payouts

5.1 Earning Revenue

Skilled Workers earn revenue when a Customer’s booking is marked as completed. A booking is considered “completed” when:

  • The Customer marks the service as completed in the app; or
  • A predefined period has passed after the scheduled service time without a dispute being raised (as specified at the time of booking); or
  • GigGap determines completion based on available evidence following a dispute review.

Revenue is credited to the Skilled Worker’s GigGap Balance after deduction of applicable commission fees. Funds received in connection with a booking may be held for a period of time to facilitate service completion, dispute resolution, fraud checks, or compliance reviews.

5.2 Withdrawals

  • Earnings can be withdrawn from the relevant page once the order is marked as completed.
  • Partial withdrawals may not be supported depending on your region or payout method. Where partial withdrawals are unavailable, you must withdraw your full available balance at once.
  • Withdrawals are typically processed within 3–5 business days, but may take longer depending on the payout provider, banking system, or regulatory checks. Withdrawal timeframes are estimates only and are not guaranteed.
  • Withdrawals are processed through the payout method configured in the Skilled Worker’s account settings. Available payout methods may vary by country.
  • Withdrawals are irreversible once initiated and cannot be undone.
  • If a payout fails due to incorrect account details, provider issues, or other errors, the funds will be returned to your GigGap Balance (less any applicable fees charged by the payout provider) and you may be required to update your payout information before initiating a new withdrawal.

5.3 Withdrawal Holds and Restrictions

GigGap reserves the right to temporarily hold, delay, or disable a Skilled Worker’s ability to withdraw revenue in the following circumstances:

  • To investigate suspected fraudulent, illicit, or unauthorised activity;
  • In response to reported improper behaviour by other users;
  • Where a dispute or chargeback has been raised in relation to the transaction;
  • To comply with applicable law, regulatory requirements, or court orders; or
  • To maintain the security and integrity of the Platform.

We will notify you if a hold is placed on your funds and will resolve the matter as promptly as reasonably practicable. Funds will be released once the issue is resolved, unless we are required to withhold them by law or determine that the funds were obtained in violation of these Terms.

5.4 Identity Verification (KYC)

We may require identity verification (Know Your Customer), business verification, or additional documentation before enabling withdrawals or continuing access to payment services. This may include government-issued identification, proof of address, business registration documents, or other information as required by applicable law or our payment processors. Failure to provide requested information within a reasonable timeframe may result in delays, restrictions, or suspension of your ability to withdraw funds or use payment services.

5.5 Inactive Accounts

If a Skilled Worker’s account remains inactive for a continuous period of 12 months (no withdrawals, no completed bookings), GigGap may contact you regarding your outstanding balance. Unclaimed funds will be handled in accordance with applicable law.

6. Customer Balances

6.1 GigGap Balance

Customers may hold a balance on their GigGap account through refunds, promotional credits, or direct top-ups (where available). The GigGap Balance is not a bank account, does not earn interest, and is not protected by any deposit guarantee scheme or insurance programme. The GigGap Balance is a contractual ledger entry used solely for facilitating transactions on the Platform. It does not represent electronic money, stored value, or a bank deposit and may not be redeemable for cash except where required by law. We may use automated systems and manual review processes to detect fraud, abuse, or suspicious activity related to balances and transactions.

6.2 Use of Balance

Customer balances may only be used to pay for services on the Platform. Customers cannot withdraw funds from their GigGap Balance to an external account or payment method.

6.3 Balance Expiry

Promotional credits or vouchers may have expiry dates, which will be communicated at the time they are issued. Refunded amounts credited to your GigGap Balance do not expire while your account is active.

6.4 Negative Balances

If your account balance becomes negative (for example, due to refunds, chargebacks, reversals, or fee adjustments), you agree to promptly repay the outstanding amount. GigGap may recover such amounts from future earnings, deduct them from future deposits to your GigGap Balance, or pursue other lawful means of recovery. Until the negative balance is resolved, your access to payment services may be restricted.

7. Refunds

7.1 Refund Eligibility

Refunds may be issued in the following circumstances:

  • The Skilled Worker fails to deliver the booked service;
  • The service was not performed as described or agreed;
  • A duplicate or erroneous charge was made; or
  • As otherwise determined by GigGap in its review of a dispute (see Section 8).

7.2 Refund Amount

Refunds are limited to the amount actually paid by the Customer after any discounts or vouchers have been applied. Vouchers are consumed at the time of booking and are not automatically reinstated upon a refund. If you would like a replacement voucher, please contact our support team and we will do our best to assist.

7.3 Refund Method

Refunds are issued to your GigGap Balance by default. Where applicable and technically possible, refunds may be returned to the original payment method used for the transaction. The refund method will be communicated to you at the time the refund is processed.

7.4 Refund Processing Time

Refunds to your GigGap Balance are processed immediately. Refunds to external payment methods may take up to 10 business days depending on your payment provider.

7.5 Non-Refundable Fees

Service fees charged by GigGap (as described in Section 4) are non-refundable unless required by applicable law or explicitly stated otherwise.

8. Payment Disputes

If you encounter any payment issue, discrepancy, or believe a charge was made in error, please contact our support team promptly at contact@gig-gap.com. Disputes should be raised within 30 days of the transaction date.

8.2 Dispute Resolution

GigGap will review the dispute and may request additional information from either party. We aim to resolve disputes within 14–30 days, though complex cases may take longer. GigGap may, at its sole discretion, review and make a final determination regarding disputes related to payments processed through the Platform. Such determinations will be applied to funds held or processed by GigGap or its payment processors. Nothing in this section limits your right to pursue remedies available under applicable law.

8.3 Chargebacks

If you initiate a chargeback or payment reversal through your payment provider without first raising a dispute with GigGap, we reserve the right to:

  • Suspend your account pending investigation;
  • Deduct the disputed amount from your GigGap Balance (if applicable); and
  • Recover any amounts owed, including chargeback fees imposed by our payment processor.

We encourage users to contact us directly before initiating a chargeback so we can attempt to resolve the issue.

You remain financially responsible for any chargebacks, reversals, or payment disputes associated with your transactions, including any fees imposed by payment processors. GigGap may recover such amounts from your GigGap Balance, future earnings, or by other lawful means.

9. Cancellations

9.1 Customer Cancellations

Customers may cancel bookings subject to the cancellation conditions specified at the time of booking. Refund eligibility for cancellations depends on how far in advance the cancellation is made:

  • Cancellations made within the free cancellation window (if applicable) will receive a full refund.
  • Late cancellations may be subject to a cancellation fee or partial refund, as communicated at the time of booking.

9.2 Skilled Worker Cancellations

Skilled Workers may cancel accepted bookings with reasonable notice. Repeated cancellations by a Skilled Worker may result in account restrictions, reduced visibility on the Platform, or account suspension.

9.3 No-Shows

If a Customer or Skilled Worker fails to show up for a confirmed booking without prior cancellation:

  • The Customer may forfeit the full payment.
  • The Skilled Worker may not receive payment for the missed booking and may face account restrictions.

GigGap will determine outcomes on a case-by-case basis at its discretion.

10. Currency

All transactions on GigGap are conducted in the currency specified during the transaction process. Supported currencies may vary by country. Currency conversion fees may apply if your payment method uses a different currency from the transaction currency. Such fees are charged by your payment provider, not by GigGap.

11. Taxes

You are solely responsible for determining and fulfilling any tax obligations arising from your transactions on GigGap, including income tax, VAT, withholding tax, or any other applicable taxes in your jurisdiction.

GigGap does not provide tax advice. We recommend that you consult with a qualified tax professional regarding your obligations.

GigGap may be required by law to withhold taxes or report transaction information to tax authorities in certain jurisdictions. Where this applies, we will notify you to the extent permitted by law.

12. Prohibited Payment Activities

You agree not to use the payment services on the Platform to:

  • Process payments for services not booked through the Platform;
  • Launder money or finance illegal activities;
  • Use stolen, fraudulent, or unauthorised payment methods;
  • Manipulate pricing, fees, or transaction amounts;
  • Collude with other users to create fictitious transactions; or
  • Circumvent any payment controls, limits, or security measures.

We may screen transactions and users against sanctions lists and anti-money laundering databases and may block or report transactions where required by law. You may not use the Platform’s payment services if you are the subject of economic sanctions or are located in, or a resident of, a country or territory that is the subject of comprehensive sanctions (including, but not limited to, sanctions maintained by the United Nations, the United Kingdom, the European Union, or the United States).

Violation of this section may result in immediate account suspension, forfeiture of funds, and referral to relevant authorities.

13. Termination and Suspension

We reserve the right to suspend or terminate your access to payment services on the Platform for violations of these Payment Terms, the Terms of Service, or applicable law.

Upon suspension or termination:

  • Customers: Any GigGap Balance may be refunded to you via your original payment method, subject to applicable deductions for fees, chargebacks, or amounts owed.
  • Skilled Workers: Any outstanding balance owed to you will be paid out in accordance with Section 5, subject to any holds, deductions, or legal obligations.
14. Limitation of Liability for Payments

To the fullest extent permitted by applicable law, GigGap shall not be liable for:

  • Losses arising from payment processing delays, failures, or errors caused by third-party payment processors, banks, or mobile money operators;
  • Unauthorised transactions resulting from your failure to safeguard your account credentials or payment information;
  • Currency conversion losses or fees charged by your payment provider; or
  • Any indirect, incidental, special, consequential, or punitive damages arising from payment-related matters.

GigGap shall not be liable for any failure or delay in payment processing or payouts due to events beyond its reasonable control, including failures of payment processors, banking systems, telecommunications networks, or regulatory actions.

Nothing in this section excludes or limits our liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

15. Changes to Payment Terms

We may update these Payment Terms to reflect changes in our payment services, fee structure, or legal requirements. Material changes will be communicated to you at least 30 days before they take effect via the Platform, email, or in-app notification. Your continued use of payment services after the effective date constitutes acceptance of the updated Payment Terms.
